The breaking of judicial authority decision as issued concerning the guardianship or custody of child

In the family cases field, there is time special after divorce. when one from parents has hand over the child and the other part has claimed a case against to get the right of custody or guardianship. that is Common in the life after divorce, then when the claim has finished by decree to give a right of custody or guardianship for the second part, there is some of people directly thinking about to break that final decree by running with the child, or obeys the decree and then kidnaps the child after.

For that there is special criminal article to make this action forbidden at all, we will show it in follow:

The penalty is:

Detention for a period not exceeding one year, or a fine not exceeding five hundred pounds shall be inflicted on

The offender:

1. The parent or grandparent who does not accept the  final court decree.
2. The parent or grandparent who kidnaps the child, personally or by others, from those who, by a decision of the judicial authority, have the right of guardianship or custody of the child, even if the kidnapping takes place without coercion or circumvention.

Who has the right to claim this criminal case:

The person who have a decree of the judicial authority as issued concerning its guardianship or custody.and this decree has to be final.
