The Rules of Hand Over the Child

In facts the wives are facing some time situation, when husbands are taking the baby from his mother and refuse to let her care about him without any legal reason, in this case if the child he /she still in the age of women care, she has a right to make legal request to the public prosecutor to get from him a interim decision to hand over the child. this is not mean that the husband doesn’t has any right about the child, but the child in this age is  in need to mother care more than father care.

 The family law has determined rules about that:

1. The public prosecutor has the authority to grant interim decisions, when the mother make a legal request which is calling (3araied Mohamy 3am)about child care right, if that child in the custody of the age of the women care, to those who have a right about that, so that the Public prosecutor has a right to issue after conduct a timely investigation, causing a decision to hand over the child of his interests achieved with it.

2 – The decision issued the extradition of a young child and enforceable by law without bail.

3 – Shall implement the provisions and decisions of child care, save and handed over by  legal force.

These rules are so famous and every family lawyer in Egypt know and use it a lot.
