These types of crimes are totally contrary with the nature of the Egyptian social life, as it is one of the Middle East Islamic countries , but according to the normal stream of the human beings corruption and the refraction of law system disappearing in the time of revolutions or war, these types of crimes has been rise up to the surface of Egypt social life by powerful actions.
Which was important to let the legislature during the 2011 revolution to issue an amendment to the Criminal Code toughening punishment for those kind of crimes.
Rape is a type of sexual assault usually involving sexual intercourse or other forms of sexual penetration perpetrated against a person without that person’s consent. The act may be carried out by physical force, coercion, abuse of authority or against a person who is incapable of valid consent, such as one who is unconscious, incapacitated, or below the legal age of consent. The term rape is sometimes used interchangeably with the term sexual assault. according to Egypt legal system we cannot imagine this kind of crime against any one except adult and sane females.
For that there is special criminal system for facing these kinds of crimes, will show that in follows:
The rape:
Whoever lies with a female without her consent shall be punished with a death sentence or rigorous imprisonment If the felon is from the victim’s ancestors, or those in charge of rearing, observing, or having power on her, or is a paid servant to her or to the aforementioned persons,or in the case of multiple offender, he shall be punished with a death sentence.
Indecently assaults:
Whoever indecently assaults a person by force or threat, or attempts such assault shall be punished with rigorous imprisonment.
If the victim of the said crime has not attained complete eighteen years of age, or If the felon is from the victim’s ancestors, or those in charge of rearing, observing, or having power on her, or is a paid servant to her or to the aforementioned persons,or in the case of multiple offender, he shall be punished with rigorous imprisonment for seven years .
If these two conditions combine together, the ruling shall be a sentence to rigorous imprisonment.
Whoever indecently assaults a lad or a lass not yet attaining eighteen complete years of age, without force or threat shall be punished with detention. If he or she has not attained twelve complete years of age, If the felon is from the victim’s ancestors, or those in charge of rearing, observing, or having power on her, or is a paid servant to her or to the aforementioned persons,or in the case of multiple offender, the penalty shall be rigorous imprisonment not less than seven years.
The corruption of Morals:
Whoever is found on a public road or a traveled and frequented place inciting the passers with signals or words to commit adultery shall be punished with detention for a period not exceeding three months. If the felon recurs to committing this crime within one year from the date the final court ruling is passed against him in the first crime, the penalty shall become detention for a period not less than one year and a fine not less than fife hundred pounds to three thousand pounds . A ruling of indictment shall necessitate placing the convict on police parole for a period equal to that of the penalty.
